Nexium® is a brand-name brand of esomeprazole magnesium (Nexium Magnesium) delayed-release tablet, which is used to treat frequent heartburn and acid reflux symptoms. A federal judge in Louisiana issued a $2 million settlement with the manufacturer of a heartburn drug that claimed the company knew or should have known about the cancer risk and not just acted with the intent to harm it, the court said.
But the drug maker sued to block the settlement and win the case. That means the lawsuit has already begun to wind up being filed in state court.
The U. S. District Court for the Eastern District of New York held that the company knew or should have known about the risk of heartburn before making the dangerous drug. The company also said the federal court judge was not in the best position to decide whether the government should be liable in damages for the damage it caused the plaintiff.
The lawsuit is being brought by the company that had developed the drug in the heartburn drug Nexium in the 1990s. That drug, known as esomeprazole, was developed by AstraZeneca, maker of Nexium and AstraZeneca, maker of Prilosec and Prevacid.
The Nexium manufacturer is alleged to have known of the risk before making the drug and knew of it in 1997.
The Nexium plaintiffs claimed that the company failed to properly warn consumers about the cancer risk before making the drug, but it did not act with the intent to harm them. It also claimed that the company did not act with the intent to harm the plaintiff because it had knowledge of the drug’s cancer risk before making the drug.
The judge in the Nexium case is due to go to trial next year. He will be allowed to rule on the Nexium case until December. In the case, it would be the largest federal court in the nation. The judge will decide the Nexium case.
“We are pleased to finally have a settlement with the manufacturer of Nexium,” said Joseph D’Amico, Jr., who filed the Nexium lawsuit in Louisiana.
“The plaintiff is not alone. Nexium, as the only acid reflux drug on the market, was known to have an increased risk of cancer of the colon, endometrial tissue, and stomach lining and that is why we were forced to stop the Nexium manufacturer from making the dangerous drug,” D’Amico said. “We are committed to protecting our patients and we are doing all we can to help protect the public.”
He said the Nexium company has agreed to pay $2 million in damages to the plaintiffs and has not made any payment to the federal government. But the Nexium case is being appealed by the plaintiffs.
The Nexium plaintiffs filed the case on Friday.
“The case is finally being appealed,” said Thomas P. Johnson, attorney for the plaintiffs.
“We are disappointed,” said Michael J. Jepsen, an attorney for the Nexium plaintiffs who filed the case on Friday. “We are disappointed that we were unable to get a settlement and that we have been given an inadequate opportunity to get a case back on track.”
The Nexium plaintiffs claimed that the government was in the best position to pay their damages. They argued that the government had already paid them for the Nexium plaintiffs’ medical bills and that the Nexium plaintiffs had to pay for the government’s damages.
The federal court judge agreed to the settlement and ordered the Nexium plaintiffs to pay the full $2 million in damages.

“The plaintiffs’ settlement agreement was clearly an attempt to get money out of the plaintiff,” said James T. Johnson, a plaintiff in the Nexium case.
“The plaintiffs’ counsel argued that the case was a ‘fraudulent settlement,’” said S. J. Johnson, an attorney for the Nexium plaintiffs who filed the case. “It was not.”
The Nexium plaintiffs and the federal judge declined to rule on the case.
